A settlement has been reached in a class action lawsuit involving Nevada Restaurant Services, following a data breach in January 2021. The breach, which affected individuals who received a notification from the company, allegedly exposed sensitive information such as Social Security numbers, financial account details, and health insurance data. The lawsuit claims that Nevada Restaurant Services failed to implement adequate cybersecurity measures to prevent the breach.
Though Nevada Restaurant Services has not admitted to any wrongdoing, they have agreed to settle the lawsuit by paying an undisclosed amount. Under the settlement terms, affected individuals can claim up to $10,350 for losses related to the breach. This includes compensation for ordinary losses like bank fees and communication charges, and up to $10,000 for extraordinary losses such as identity theft or fraud.
Class members who do not have documented losses can opt for a cash payment of $50. Additionally, the settlement includes three years of credit monitoring and identity theft insurance. If claims exceed $150,000, payments may be reduced on a pro rata basis.
The deadline to submit a valid claim form is September 17, 2024, with the final approval hearing scheduled for November 7, 2024. The deadline for exclusions and objections is August 19, 2024.
