Avis Faces Lawsuit Over Data Breach Claims

Avis Rent A Car System LLC has been hit with a class action lawsuit following a data breach that exposed the personal information of over 300,000 individuals. The lawsuit, filed by plaintiff Jason Shay in September 2024, alleges that Avis was negligent in its security measures, which allowed hackers to access sensitive data between August 3 and August 6, 2024. The exposed data includes names, driver’s license numbers, birth dates, credit card information, and phone numbers, which were reportedly sold on the dark web.

Shay claims that the breach has significantly increased the risk of identity theft and financial fraud for the affected individuals. He asserts that Avis’s failure to take adequate steps to protect its customers’ personal information has caused ongoing harm. As a result, he now faces the added burden of monitoring his accounts and personal information to prevent further damage.

The lawsuit highlights Avis’s duty to protect its customers’ sensitive data, given its role as a major rental car company. The plaintiffs argue that Avis’s negligence in safeguarding this information allowed unauthorized access, which led to the data exposure. Shay is seeking compensation for damages and also calling for a court order to require Avis to improve its data security practices and offer lifetime identity theft protection to the affected individuals.

Shay is looking to represent anyone whose personal or financial data was compromised in the breach. The class action seeks damages, fees, costs, and a jury trial, along with the certification of the class. The plaintiff is being represented by attorneys from the law firm Edelson Lechtzin LLP.
