CPPA Proposes New Rules for Data Brokers

On July 5, the California Privacy Protection Agency (CPPA) released a Notice of Proposed Rulemaking (NPRM) to amend the Delete Act. This act, officially known as SB 362, was enacted in 2023 and shifted the oversight of California’s Data Broker Registry from the Office of the Attorney General to the CPPA starting in 2024. The proposed amendments aim to refine the Act by introducing details on registration fees, defining key terms, and clarifying registration and disclosure requirements.

The CPPA’s proposed changes include setting a registration fee of $400 along with any processing fees for electronic payments. It also introduces definitions for terms such as “minor,” “register,” “registration period,” and “reproductive health care data.” These clarifications are intended to ensure that data broker businesses register uniquely and meet specified standards.

Additionally, the amendments seek to enhance transparency in the data collection industry and expand consumer rights regarding the usage of their data. The CPPA aims to provide a clearer understanding of data practices and offer consumers better control over their personal information.

To gather public feedback, the CPPA will hold a virtual public hearing on August 20. During this hearing, stakeholders can present oral statements, while written comments are accepted until the end of the hearing period.
